1. Introduction

These terms and conditions govern the relationship between ART-fordable ("we", "us", or "our") and the customer ("you") of the ART-fordable website ("website") and the purchase of products from our online store. By accessing or using our website, you agree to be bound by these terms and conditions. If you disagree with any part of these terms and conditions, please do not use our website.

We are committed to providing excellent customer service. You can contact us anytime via email at message.art.fordable@gmail.com. We aim to respond to all inquiries within three working days. Our standard business hours are Monday to Friday from 9:30 am to 5:00 pm.

4. Sales to Customers and Businesses

While our primary focus is selling to customers, we also welcome business inquiries. Please contact us via email for more details or bespoke requests.

5. Returns and Refunds

  • Customers are protected by a 14-day cooling-off period.
  • Returns of undamaged goods will be accepted within the 14-day cooling-off period.
  • Shipping costs and insurance for returns are the customer's responsibility. In case the return is not insured and lost during transit, no refund will be possible. If the customer can show a valid proof of shipment, partial refund can be discussed. 
  • It is appreciated, though not mandatory, for customers to inform us via email of their intention to return a product and provide a reason for the return.
  • Reimbursement will be processed upon safe receipt of the returned print and confirmation of its adequate condition.

6. Intellectual Property

All images, texts, descriptions, and intellectual property associated with the items sold on the ART-fordable website belong to ART-fordable and the respective artists of the artworks. We do not authorize any reproduction, partial or total, or use, commercial or non-commercial, of these materials without prior written consent from ART-fordable or the respective artists. Unauthorized use of any intellectual property may result in legal action.

We process customer data for order fulfillment purposes. If customers voluntarily register for our communications, they may request access to their data information and opt-out of communication at any time by sending an email to message.art.fordable@gmail.com.

8. Shipping Policy

We ship all orders via Post.nl and ensure that each shipment is securely packaged to protect the prints during transit. Shipping costs are calculated and displayed at checkout. For international shipments outside the EU, additional import taxes may apply, which are the responsibility of the customer. Upon receipt of the shipment, if there are any issues with the packaging, the customer should refuse delivery and inform both the carrier and ART-fordable immediately. All shipments are insured for the value of the print.

9. Payment Terms

Payment is required at checkout before shipment. No deferred payment options are available. We accept a wide range of payment methods, all of which are accessible on the website.

10. Dispute Resolution

In the unlikely event of a dispute arising between ART-fordable and a customer, we are committed to resolving the issue promptly and fairly. Disputes may arise concerning the condition of the print upon delivery or the reimbursement process for undamaged goods.

  • Condition of the Print: If a customer receives a print that is damaged during shipping, they should refuse delivery and promptly inform both the carrier and ART-fordable. We will immediately leverage the insurance coverage to address the issue and arrange for the reshipment of the same print at no additional cost to the customer.
  • Reimbursement Process: Customers seeking reimbursement for undamaged goods should provide detailed and informed documentation supporting their claim. This documentation may include photographs of the print upon delivery, along with any relevant information regarding the condition of the packaging. We will review the provided documentation and, if deemed appropriate, proceed with the reimbursement process. Please note that shipping costs may not be reimbursed.
  • Resolution Process: We strive to resolve all disputes in a timely and amicable manner. Customers are encouraged to communicate any concerns or issues they may have directly with us via email at message.art.fordable@gmail.com. We will carefully consider all relevant information provided by the customer and seek to reach a fair and satisfactory resolution for all parties involved.
  • Cost of Transaction: In the event of a dispute, any resolution will be limited to covering the possible costs associated with the transaction and will not entail any additional payment of costs by either party.

11. Limitation of Liability

ART-fordable shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, or use, incurred by the customer or any third party, whether in an action in contract, tort, or otherwise, arising from the use of or inability to use the products or services provided by ART-fordable.

12. Governing Law

These terms and conditions are governed by and construed in accordance with the laws of the Netherlands. Any disputes relating to these terms and conditions shall be subject to the exclusive jurisdiction of the courts of the Netherlands.

13. Modification of Terms

ART-fordable reserves the right to modify these terms and conditions at any time. Any changes will be effective immediately upon posting on our website. Continued use of the website following any such changes constitutes your acceptance of the revised terms and conditions.
